(Seattle, WA), A federal judge today granted Washington state’s request for a temporary restraining order against a presidential order that aimed to halt federal funding for medical institutions providing gender-affirming care.
The executive order issued by President Trump directs a reduction in federal funding to institutions offering gender-affirming medical care and calls for potential criminal enforcement against medical professionals and patients involved in such care. Washington’s Attorney General Nick Brown has argued that the order oversteps legal boundaries and could have detrimental effects on medical providers and youth seeking necessary care.
“This order ensures that young people can continue to access essential gender-affirming medical care, and healthcare providers can continue to deliver the care they deem best for their patients,” Brown said. “We’re pleased that the court’s decision helps maintain support for Washington’s medical and research institutions as they continue their important work.”
Joining Washington in the lawsuit are the attorneys general of Minnesota and Oregon, as well as three individual doctors who represent themselves and the minors under their care.
The states argue that the order undermines constitutional protections, singling out transgender individuals in a way that may violate the 5th Amendment’s equal protection clause. They also contend that the president’s action oversteps his authority by attempting to reverse funding already authorized by Congress and by regulating medical practices in ways that are protected under the 10th Amendment.
In her decision, Judge Lauren King stated that the executive order raises concerns about discrimination against transgender youth.
